Terms of Use
These Terms of Use ("Terms") govern your use of carefirstinsuranceadvisors.com (the "Site") operated by Care First Insurance Advisors LLC ("Care First," "we," "us"). By using the Site or submitting a quote request you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. Who we are
Care First Insurance Advisors LLC is a licensed insurance agency headquartered in St. Petersburg, Florida (Florida agency license #L135165). We help individuals and families compare and enroll in insurance products offered by third-party insurance carriers. We are not an insurance carrier and do not underwrite, issue or pay claims on any policy. Our licensed agents are compensated by the carriers whose products they sell. We are not affiliated with or endorsed by the U.S. government, the federal Medicare program, Healthcare.gov or any state marketplace.
2. Eligibility
You must be at least 18 years old and a resident of the United States to request a quote or use the Site. By using the Site you represent that the information you provide is accurate and that you have the right to provide it.
3. Quotes are not offers of coverage
Quotes, premium estimates and plan descriptions on the Site or provided by an agent are for information only and are not an offer, binder or guarantee of coverage. Coverage is available only through a carrier's application, subject to that carrier's eligibility rules, underwriting and policy terms. Product availability, benefits, exclusions and pricing vary by state and change over time. Read the plan documents before enrolling. Short term medical, fixed indemnity, hospital indemnity, accident and critical illness plans are not comprehensive major medical health insurance and are not a substitute for coverage that meets the Affordable Care Act's minimum essential coverage requirements.
4. Communications consent
The quote form on the Site lets you choose, by separate unchecked boxes, whether Care First and its licensed agents may contact you by phone call, by text message and by marketing email. Each choice is optional, none is a condition of purchase, and each can be withdrawn at any time as described in our Privacy Policy. Clicking the submit button on the form constitutes your electronic signature under the federal E-SIGN Act and applicable state law, and you agree that we may keep an electronic record of your consent, including the date, time, IP address and consent language shown to you.
5. Text messaging program terms
The following terms apply if you opt in to text messages. The complete program terms are on our SMS Terms page, which is part of these Terms.
- Program name: Care First Insurance Advisors Alerts & Offers.
- What you'll receive: quote follow-ups from a licensed agent, appointment reminders, account and service notifications, and marketing or promotional messages about insurance products from Care First Insurance Advisors. Messages may be sent using an automated system.
- Message frequency: varies; conversational messages with your agent may be frequent while you are actively working together.
- Cost: message and data rates may apply. We do not charge for the program.
- Opt out: reply STOP to any message at any time. You will receive one confirmation message and no further texts.
- Help: reply HELP to any message, call (888) 302-0503, or email info@carefirstinsuranceadvisors.com.
- Carriers are not liable for delayed or undelivered messages.
- Privacy: your mobile number and text-message opt-in will not be shared with third parties or affiliates for their marketing purposes. See our Privacy Policy.
6. Acceptable use
You agree not to use the Site to submit false or misleading information, to submit another person's information without their authorization, to interfere with the Site's operation or security, to scrape or harvest content or data, or for any unlawful purpose. We may block access or refuse service to anyone who violates these Terms.
7. Intellectual property
The Site and its content, including text, graphics, logos and design, are owned by Care First or its licensors and are protected by copyright and trademark law. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission.
8. Third-party links and carriers
The Site may link to carrier, enrollment and other third-party websites. We do not control and are not responsible for their content, terms or privacy practices. Your relationship with any insurance carrier is governed by that carrier's policy documents.
9. Disclaimer of warranties
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components. Nothing on the Site is legal, tax or medical advice.
10. Limitation of liability
To the fullest extent permitted by law, Care First and its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data or profits, arising out of or related to your use of the Site, even if advised of the possibility. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Some states do not allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable insurance law.
11. Indemnification
You agree to indemnify and hold harmless Care First from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your misuse of the Site.
12. Governing law and disputes
These Terms are governed by the laws of the State of Florida without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought in the state or federal courts located in Pinellas County, Florida, and you consent to their jurisdiction. Complaints about an insurance agent or agency may also be directed to the Florida Department of Financial Services or your state's insurance department.
13. Changes to these Terms
We may update these Terms at any time by posting a revised version with a new effective date. Your continued use of the Site after a change means you accept the revised Terms.
